Why is a sequence listing needed?

It is necessary to submit separate sequence listing documents to represent the disclosed sequences when submitting a patent application for inventions that contain specific sequences are disclosed in the patent specifications.

For every DNA sequence with ten (10) or more nucleotides and/or any amino acid sequence with four (4) or more specified amino acids, patent offices require the applicants to submit sequence listings in a standard format (WIPO Standard ST26, WIPO Standard ST25, US 37 C.F.R. 1.821–1.825).

Why Synoptic IP?

Who requires a sequence listing?

IP lawyers (in corporations or law firms) are writing the patents for DNA and peptide sequences.

Sequence listing benefits:

  • Genetic sequences are regarded legally and practically in a patent document as either chemical molecules or as elements that encode information. Their structure and function are quite significant in determining patent eligibility or infringement.
  • An applicant can create a single listing through the use of a sequence listing that will be accepted by all receiving offices, preliminary examining authorities, and international searching authorities, as well as all selected and chosen national phase offices and international phase offices.
